Following the changes to the Marriage Act on 7 December 2017 and previous law changes in November 2008 people who are in same sex de facto relationships and marriages have the same rights as heterosexual de facto couples.
Outcomes of the Law changes effecting financial planning issues include:
•Provision for marriage and divorce;
•Access to death benefits from your partner’s superannuation fund;
•Recognition as a couple for Centrelink purposes when determining your eligibility for benefits. This is also the case for calculating refundable accommodation deposits, daily accommodation payments, daily and means tested fees for Aged Care placements and Home Care packages;
•A couple and their children can now access the Medicare and PBS safety nets as a family;
•In the event of a relationship breakdown, child support can now be sort; and
•Should your partner be a serving Armed Forces Member you can access certain entitlements such as the War Widow’s Pension.
